Opinion By: Robert F. Stephens, Attorney General; Carl T. Miller, Jr., Assistant Attorney General
Thank you for your response to our letter requesting that you send us certain documents desired for inspection by Mrs. Brenda Butler. The documents we requested were: (1) records pertaining to administrators in the Boone County School System including the superintendent, assistant superintendents, principals and assistant principals as to their educational degree, certification and rank; (2) the year the above named were hired and the number of years employed in the Boone County School System and (3) the promotions gained and the year the promitions were gained by the above named.
You sent us the records described in 1 and 2. You explained that you have no records listing the promotions gained and that that information is contained only in the minutes of the Boone County Board of Education.
OPINION OF THE ATTORNEY GENERAL
As required by KRS 61.880 (2) we give the following opinion.
It is the opinion of the Attorney General that the documents you sent us are public records, that they are not exempted by the open records law or any other statute from public inspection, and they are therefore legally subject to public inspection by any person. It is our opinion that in so much as you do not have any listing showing the promotions gained and the year the promotions were gained you are not legally required to compile such a listing. You will be sufficiently complying with the open records law by making the minutes of the Board of Education available for public inspection at reasonable times and under reasonable circumstances.
