You have requested an opinion of the Attorney General as to whether a joint meeting of the Henderson City Commission and the Henderson County Magistrates held on July 26, 1977 was lawfully held in part in a closed session. You state that the two above named public agencies jointly conduct an ambulance service and that the purpose for which they went into closed session was to discuss setting ambulance service rates to the race tracks.
The Kentucky Open Meetings Law, KRS 61.805 - 61.850, provides that all meetings of public agencies shall be open to the public except for four subject matter exceptions. The four exceptions as found in KRS 61.810 are deliberations on the future acquisition or sale of real property, discussions of proposed pending litigation, collective bargaining negotiations between public employees or their representatives, and discussions or hearings which might lead to the appointment, discipline or dismissal of an individual employee. There is no provision for a closed meeting on the part of the public agency to discuss the terms upon which it will sell services to private individuals or corporations.
It is therefore our opinion that the meeting you describe should have been held in open session.
