In your letter of October 10, 1978, you inquire as to whether a Moped operator is required to have a drivers license.

House Bill 25 (1978) amended KRS 186.410 to provide that every person who operates a Moped on a highway must have either a regular operator's license or a Moped operator's license. The difference between the two is that a Moped operator's license may be obtained without taking the driving test required by a regular license. Such a license is restricted to the operation of a Moped.

It is our opinion that a person must comply with all the requirements of a regular operator's license, including age, to obtain a Moped operator's license except the requirement of taking and passing the driving test.
