You have appealed to the Attorney General on behalf of your client, Mrs. Doris N. Stokes, the denial by the University of Louisville of the inspection of certain records. The records in question are: "All Responses from University of Louisville employees to the inquiry dated March 16, 1977 from Dr. Peggy A. Rabkin, Director of Affirmative Action Office." You enclosed with your letter of appeal a letter from Daid L. Baker, University Counsel, dated September 15, 1978, in which Mr. Baker stated that the records in question were being withheld from inspection because they were preliminary and advisory materials and materials of a personal nature.
It is the opinion of the Attorney General that subject records are being properly withheld from public inspection. KRS 61.878(1)(g)(h) exempts correspondence with private individuals and preliminary recommendations and preliminary memoranda in which opinions are expressed or policies formulation. We believe that the records described in this appeal are private correspondence and also preliminary memoranda.
We are sending a copy of this opinion to Mr. David L. Baker, counsel for the University of Louisville, as required by statute. Your client has the right to challenge this opinion in the circuit court. KRS 61.880 (5).
