This is in answer to your letter of February 12 in which you request an opinion concerning the following:

"Please advise me of the effective date of legislation enacted during the 1979 Extraordinary Session of the General Assembly, which does not contain a special effective date."

In response to the above question, we are of the opinion that all ordinary legislation enacted at the 1979 special session of the legislature will become effective on May 12, 1979.

In determining the effective date, February 10 [the day of adjournment] must be excluded, which means that May 11 would be the 90th day following adjournment which must be included in computing the 90-day time period prescribed in § 55 of the Constitution thereby making all ordinary legislation effective on May 12.
