Opinion By: Robert F. Stephens, Attorney General; By: Walter C. Herdman, Assistant Deputy Attorney General

This is in answer to your letter of September 24 in which you raise the following question:

"Would you please advise how to handle the election officers of the up and coming special election, October 5th in Pineville for the school building taxes? (KRS 160.477)."

The answer to your question is found under the specific terms of KRS 117.045(1) from which we quote the following excerpt:

"The county board of elections shall, not later than September 20 each year, appoint for each precinct in the county two (2) judges, one (1) clerk, and one (1) sheriff of election, who shall hold their offices for one (1) year and until their successors are appointed. They shall serve in all elections held in the county during the year. . . ."

Pursuant to the above language of the statute, those officers elected in September, 1979 are required to serve in all elections during the ensuing year which would include any special election, such as the one authorized in connection with the levy of a school building tax pursuant to KRS 160.477.
