In your December 14, 1979 letter to this office you requested a clarification of procedures and policies involved in the requisition and dispensing of funds generated from the county under KRS 132.590.
In order for the PVA to be reimbursed by the county for valid expenses, the PVA need only submit a claim to the fiscal court showing the amount of expense and the item purchased. KRS 132.590(9) requires the fiscal court to pay all expenses and all claims unless the PVA has exhausted the amount of funds appropriated by the county to his office. The fiscal court can not refuse payment of such claims.
The other question you raise is the legal authority of an opinion expressed by a local government advisor of the Department of Local Government. Such an opinion is advisory only and has no force of law. KRS 147A.020 gives the Department of Local Government administrative powers only.
