Mr. Bruce E. Waring, Sr. has appealed to the Attorney General pursuant to KRS 61.880 your denial of a copy of his transcript of grades at the Police Academy. In your letter of January 7, 1983 you stated the reason for denying this transcript as follows:
"In checking our records for Class 98, your transcript was found to be incomplete because you did not make the mile and one half run which is required for all cadets graduating from our Academy."
Mr. Waring states that he is not requesting a diploma or certificate of completion but only a copy of what he has completed and his scores.
OPINION OF THE ATTORNEY GENERAL
It is the opinion of the Attorney General that Mr. Waring is entitled to inspect and obtain a copy of his academic records under KRS 61.884 which provides:
"Any person shall have access to any public record relating to him or in which he is mentioned by name, upon presentation of appropriate identification, subject to the provisions of KRS 61.878."
It is therefore our opinion that you did not act in accordance with the Open Records Law in denying Mr. Waring's request for the described transcripts. If you choose not to comply with this opinion you may challenge it in court within thirty days as provided by KRS 61.880(5).
As directed by statute a copy of this opinion is being sent to the requester.
