Opinion

Opinion By: David L. Armstrong, Attorney General; Walter C. Herdman, Asst. Deputy Attorney General

In your letter of July 24 you seek an opinion as to the effective date of ordinary legislation enacted during the 1985 special session of the General Assembly that adjourned sine die Friday, July 19, 1985.

In response to the above, we are of the opinion that ordinary legislation adopted at the 1985 special session of the Kentucky General Assembly will become effective October 18, 1985.

In determining the effective date of ordinary legislation, July 19, the day of adjournment, must be excluded which means that October 17 would be the 90th day following adjournment which day must be included in computing the 90-day period of time provided for in Section 55 of the Constitution, thereby making all ordinary legislation effective October 18. With respect to the method of computation, we refer you to OAG 72-195 and KRS 446.030.

LLM Summary
OAG 85-113 provides an opinion on the effective date of ordinary legislation enacted during the 1985 special session of the Kentucky General Assembly. It concludes that such legislation will become effective on October 18, 1985, based on the computation of the 90-day period following the adjournment of the session, excluding the day of adjournment and including the 90th day. OAG 72-195 is referenced for the method of computing this effective date.
