Open Records Decision

Mr. Joe Taylor, Jr. appeals the failure of the Mayfield Police Department to respond to his request under the Open Records Act for the dispatch log from February 16, 2000 and February 17, 2000 and the taped record of all dispatch calls involving the EOC log from February 16, 2000 and February 17, 2000. Mr. Taylor made his request by letter dated January 7, 2002 directed to the Mayfield Police Department, 215 East Broadway, Mayfield, Kentucky, 42066. When no response was received Mr. Taylor filed an appeal by letter dated January 18, 2002. By letter dated January 25, 2002, to the Office of Attorney General, the Mayfield Police Department responded stating that Mr. Taylor's request was being "filled". So long as Mr. Taylor's request is complied with, this appeal is moot. This office will follow up to verify compliance with the Mayfield Police Department.

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
