Open Records Decision

This is an appeal by Mr. Anthony Mattingly of the failure of the Kentucky State Police to respond to Open Record Requests. By letters dated December 3, 2001, and January 10, 2002, Mr. Mattingly requested copies of his NCIC report, including his juvenile record. In the first request, he gave his Social Security Number and date of birth. On January 10, 2002, Mr. Mattingly appealed to the Attorney General. By letter dated January 24, 2002, to the Attorney General, the Kentucky State Police responded by saying that it had no record of ever having received Mr. Mattingly's requests for information. A copy of Mr. Mattingly's requests to the agency will be mailed to the Official Custodian of Records for the Kentucky State Police, 919 Versailles Road, Frankfort, Kentucky, 40601. The agency will then have three (3) days to respond. KRS 61.872 (5).

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
