Open Records Decision
This matter having been presented to the Attorney General in an open records appeal, and the Attorney General being sufficiently advised, we find that the Kentucky Housing Corporation did not violate the Open Records Act in denying Steven Farmer's March 6, 2006, request for rental assistance payment records for properties located at "112 Bracken Augusta Kentucky 41002" and "302 Frankfort Augusta Kentucky 41002" on the basis of KRS 61.878(1)(a). It is the decision of this office that 06-ORD-066, a copy of which is attached hereto and incorporated by reference, is dispositive of the issue on appeal. The facts presented in the instant appeal are virtually indistinguishable from the facts giving rise to our decision in 06-ORD-066, and we see no reason to depart from the legal analysis and conclusions set forth therein. We find no error in the Kentucky Housing Corporation's denial of Mr. Farmer's request.
A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
