The Kentucky Attorney General issued the following open records decisions last week:

1. 25-ORD-047 (In re: Joseph Childers/University of Kentucky)

Summary: The University of Kentucky violated the Open Records Act when it denied a request for records under KRS 61.872(6) because it did not place an unreasonable burden on the agency. The University violated the Act when it withheld records under KRS 61.878(1)(i) and (j), to the extent they “relate[d] to” the requesting University employee within the meaning of KRS 61.878(3). However, the University did not violate the Act when it withheld privileged attorney-client communications under KRE 503(b).

2. 25-ORD-048 (In re: Jackie Jerome/Kentucky State Penitentiary)

Summary: The Kentucky State Penitentiary did not violate the Open Records Act when it denied a request for records that are exempt under KRS 61.878(1)(j).

3. 25-ORD-049 (In re: Alena Noakes/Department of Corrections)

Summary: The Department of Corrections did not violate the Open Records Act when it denied requests for records that, if released, could pose a security threat to the safety of a correctional facility.

4. 25-ORD-050 (In re: Mathew Daily/Kentucky Law Enforcement Council)

Summary: The Kentucky Law Enforcement Council violated the Open Records Act when it failed to issue a response within five business days of receiving it.

5. 25-ORD-051 (In re: Tim Arnold/Department of Corrections)

Summary: The Department of Corrections did not violate the Open Records Act when it denied two requests that did not precisely describe the records requested.
