The Kentucky Attorney General issued the following open records and open meetings decisions last week:


 

1. 25-ORD-096 (In re: David McAnally/Kentucky Horse Racing and Gaming Corporation)


 

Summary: The Kentucky Horse Racing and Gaming Corporation did not violate the Open Records Act when it stated that it had no responsive records and the requester did not

present a prima facie case that any such records existed.

2. 25-OMD-097 (In re: James Orlick/House Standing Committee on Postsecondary Education)


 

Summary: The House Standing Committee on Postsecondary

Education violated the Open Meetings Act when it failed to issue a written response to a complaint within three

business days. However, the Office lacks jurisdiction to determine whether the Committee followed its own legislative procedures.

3. 25-ORD-098 (In re: Carolyn West/Graves County Sheriff’s Office)


 

Summary: The Office cannot find that the Graves County Sheriff’s Office violated the Open Records Act because the Office is unable to resolve the factual dispute between the parties.

4. 25-ORD-099 (In re: Tanyqua Oliver/Fayette County Public School System)


 

Summary: The Fayette County School System did not violate the Open Records Act when it issued a timely response, denied a request for records that do not exist, or when it denied a request

to compile information.

5. 25-ORD-100 (In re: Ronnie Sparkman/Shelbyville Police Department)


 

Summary: The Shelbyville Police Department 

violated the Open Records Act when it did not issue a timely response to a request it received under the Act.

6. 25-ORD-101 (In re: Rob Mattheu/Union County School District)


 

Summary: The Union County School District violated

the Open Records Act when it denied a request to inspect

board of education members’ emails because the requested emails were

from email accounts the District had held out as used by the board members to conduct official business.
