Opinion

Opinion By: David L. Armstrong, Attorney General; Walter C. Herdman, Asst. Deputy Attorney General

This is in response to your letter of December 29 in which you seek an opinion as to the effective date of ordinary legislation enacted during the 1984 session of the General Assembly, assuming that it adjourns sine die Saturday, April 14, 1984.

In response to the above question, we are of the opinion that ordinary legislation adopted at the 1984 regular session of the Kentucky General Assembly will become effective July 14, 1984.

In determining the effective date of ordinary legislation, April 14, the day of adjournment, must be excluded which means that July 13 would be the 90th day following adjournment which day must be included in computing the 90-day period of time provided for in Section 55 of the Constitution, thereby making all ordinary legislation effective July 14. With respect to the method of computation, we refer you to OAG 72-195 and KRS 446.030.

LLM Summary
OAG 84-18 provides an opinion on the effective date of ordinary legislation enacted during the 1984 session of the Kentucky General Assembly, determining that such legislation will become effective on July 14, 1984. The opinion explains the method of computing the 90-day period following adjournment, excluding the day of adjournment and including the 90th day. OAG 72-195 and KRS 446.030 are cited as references for the computation method.
